Husband's action against son to whom wife had left bulk of estate for recovery of title to certain federal savings bonds. The District Court, Upshur County, Looney E. Lindsey, J., rendered a judgment holding title in the husband but imposing a lien for one-half of the value of the bonds in favor of the son and the husband appealed. The Texarkana Court of Civil Appeals of the Sixth Supreme Judicial Circuit, 337 S.W.2d 805, reversed upon holding that the son was entitled to no lien and error was brought. The Supreme Court held that it would exercise its discretion to reverse the Court of Appeals' judgment which was in conflict with a Supreme Court decision rendered after the Court of Appeals' judgment and to affirm trial court's appeal. Judgment of Court of Civil Appeals reversed; judgment of District Court affirmed.
